با توجه به پيچيدگي‌ها و وسعت پروژه‌هاي عمراني در كشور به وجود آمدن دعاوي ناشي از ادعاي پيمانكاران و كارفرمايان اجتناب‌ناپذير است؛ هميشه كارفرما به دنبال اتمام پروژه با كمترين هزينه و كمترين سود براي پيمانكار است و پيمانكار بالعكس كه اين خود نشان‌دهنده تضاد منافع طرفين است. همچنين وقوع هرگونه دعاوي منجر به ‌صرف هزينه و زمان زيادي براي حل‌وفصل مي‌شود، لذا بهتر است قبل از وقوع، با شناسايي عوامل تأثيرگذار از اتفاق افتادن آن‌ها جلوگيري به عمل آورد، ما در اين تحقيق در ابتدا به بررسي كلي در ارتباط با انواع ادعا پرداخته و سپس با بررسي و تجزيه‌وتحليل عوامل شكل‌دهنده ادعا مشخص شد كه برخي از آن‌ها به ‌راحتي غيرقابل ‌پيشگيري نبوده و لازمه‌ي آن استفاده از علوم مختلف در حوضه‌هاي مهندسي است. ازجمله روش‌هاي مطرح‌شده جهت جلوگيري از وقوع ادعا استفاده از نظريه بازي‌ها و پيش‌بيني رفتار طرفين اصلي قرارداد در موقعيت‌هايي كه به فكر منافع (مالي) خود ميباشند، است. حال با استفاده از نظريه بازي ها و تعادل استكبرگ تحت عنوان رهبر و پيرو نقطه تعادلي رفتار بين كارفرما و پيمانكار را قبل از شروع به ساخت پروژه مدل كرده و با استفاده از آن مدل مشخص ميشود كه در زمان شروع پروژه هر كدام از طرفين چه واكنش هايي نسبت به شرايط مختلف نشان ميدهند تا منابع خود را حداكثر كنند.

Propound an analytical model to prevent conflict in construction projects

Because of the complexity and extent of construction projects in iran, claims arising from negotiating among contractors and employers are unavoidable; employer always want to completion of the project with the lowest cost and the lowest benefits for contractor, and the contractor verse, which show the disagreement of profit of the parties of contract . Also, occure of any construction claims have such high impacts on the projects cost and time, so it is better to prevent the occurrence of that, before by identifying the effective factors. In this study, in this thesis at the first we identify and assess contractual and legal risk factors in sustainable construction projects which may cause claims, by analyzing the factors that claim happen, we find that some of them are not inevitableand and need touse of various sciences in engineering basins. One of the best methods that used to prevent the claims, is game theory for predict the behavior of the parties of contract in situations that they are just thinking a bout their own financial interests. Now using the game theory and equilibrium, Sockebar called the leader and follows the equilibrium point of behavior between the employer and the contractor before starting to construct the project, and using that model, it is determined which reaction at the time of the start of each side They show different circumstances to maximize their resources.
