One of these invisible but very effective factors in construction projects is claims. Increasing claims is inversely related to achieving the three main goals of project management (time, cost, and quality); So that it harms all three variables. According to previous research, every manager typically spends about 25 percent of his or her time resolving tensions and disputes, and many project stakeholders consider claims and disputes to be the most devastating events in construction projects.
In the present study, the factors affecting the claim management in construction contracts have been evaluated and prioritized using multi-criteria decision-making methods. This research is of descriptive-analytical-applied type and due to the uncertainties in the data, fuzzy concepts have been used for modeling. In this regard, first, the types of construction contracts and litigation factors were extracted according to documentary studies and expert opinions, then focusing on the knowledge and experience of managers, experts, and competent officials of construction projects in Tehran, the most important factors affecting claim management were identified and separated. Then, the fuzzy AHP hierarchical analysis process method is used to weight the contracts and its combination with the Vikor method in fuzzy conditions is used to prioritize the factors that create claims in the contracts.
The results of the implementation of these methods show that among the contracts, "contractual contract", "method contracts based on design and construction","method contract based on management and execution"," contract method of Design-Procurement-Construction", "contract method of construction, exploitation and transfer" and "trust contract" have the highest weight, respectively. In terms of impact on the occurrence of claims in construction contracts in Tehran, "improper distribution of risks, responsibilities, and obligations", "delay in payments and execution of financial obligations by the employer and the financial problems of the contractor", "mistake in execution by the contractor", "error in design and technical drawings", "poor organization of the contractor", "ambiguity and contradictions in the documents with the provisions of the contract", "the existence of objections inland delivery" , "change in the quality level of the provisions of the contract"
"wrong planning in the employer", and finally " Change in workload and do extra work" will be of the utmost importance, respectively.
Because claims cause delays, reduced quality, and increased costs in projects; Their management will be one of the effective factors in the success of construction projects. It is hoped that the results of the present study will help those in charge to properly manage the claim and reduce the negative effects of the claim on the contracts.
