در اين تحقيق هدف به دست آوردن درك يا دانش لازم براي تعيين ابزاري است كه به وسيله آن ريسك هايي كه در قراردادهاي ساخت سه عاملي مي تواند منجر به بروز دعاوي و بالطبع با تاثير بر روي اهداف پروژه با افزايش هزينه ها، افزايش مدت زمان و كاهش كيفيت كار باعث بروز آسيب و صدمات بر بدنه پروژه گردد شناسايي، اولويت بندي، سطح بندي و روابط بين آنها تبيين گردد. در اين تحقيق شناسائي و تجميع ريسكهايي كه منجر به بروز ادعا در قراردادهاي ساخت سه عاملي مي گردد از طريق انجام مطالعات كتابخانه اي و مصاحبه هاي ساختار نيافته با خبرگان صنعت ساخت در قالب 33 ريسك صورت گرفت. در ادامه به منظور رتبه بندي ريسكهاي شناسائي شده بر مبناي شاخص اهميت، پرسشنامه اي مشتمل بر 33 ريسك و بر اساس متغيرهاي احتمال وقوع ريسك، شدت تاثير ريسك در ايجاد ادعا و نحوه تخصيص مناسب ريسك بين اركان قراردادهاي سه عاملي ( كارفرما-مشاور-پيمانكار)، به معرض نظرسنجي خبرگان گذاشته شد. سپس بمنظور ارائه مدل ساختاري تفسيري با انتخاب 11 ريسك برتر به عنوان مهمترين علل بروز ادعا در قراردادهاي ساخت سه عاملي پرسشنامه مرتبط با روابط بين ريسك ها به نظرسنجي گذاشته شد. در ادامه بر اساس روش فرآيند تحليل شبكه اي با توزيع پرسشنامه هاي مقايسات زوجي جهت تعيين اهميت وزن نسبي متغيرها، اولويت بندي و وزن نهائي ريسك هاي تاثير گذار در بروز دعاوي قراردادهاي سه عاملي تبيين گرديد. در اين تحقيق بمنظور تحليل هاي آماري مرتبط با داده هاي جمعيت شناختي از ويرايش 26 نرم افزار SPSS، جهت رتبه بندي ريسك ها از نرم افزار EXCEL و در انجام فرآيند تحليل شبكه اي از نرم افزار SUPER-DECISION استفاده شده است. در ضمن در اين تحقيق نحوه تخصيص مناسب ريسك هاي قراردادهاي ساخت سه عاملي از منظر مديريت ادعا با نحوه تخصيص ريسك در شرايط عمومي پيمان قراردادهاي متعارف و پيش نويس جديد آن كه در مراحل نظرسنجي و بررسي مي باشد مورد مقايسه واقع گرديد.

A model for management of claims caused by the risks of D.B.B construction contracts

The research has been aimed at obtaining required knowledge or perception to determine a tool by which to identify, prioritize, classify, and explain the relationship between those risks in Design - Bid - Built construction contracts that can lead to legal claims and negative impact on project through increase of costs, increase of project’s time duration, and decrease of work quality. In the research, identification and integration of those risks leading legal claims in D.B.B construction contracts have been performed through library studies and unstructured interviews with the industry’s experts in relation to 33 risks. In continuation and to rank identified risks based on importance indicator, a questionnaire including 33 risks has been submitted to experts for their views, based on following variables: probability of occurrence of risk; severity of risk’s impact in start of a claim; and how to appropriately allocate risk to foundations of D.B.B construction contracts (employer-consultant-contractor)? To provide interpretive structural model, 11 superior risks have been selected as the most important reasons for start of legal claim in D.B.B construction contracts so that the questionnaire related to the relationship between risks would be put on survey. In continuation and based on analytical network process, pairwise comparison questionnaires have been distributed to determine importance level of relative weight of variables; and, prioritization, and final weight of effective risks in starting legal claims in D.B.B construction contracts have been explained. In the research and for statistical analyses related to demographical data, 26th edition of SPSS has been used; and, to rank risks and to do analytical network process, Excel and Super-decision software have been applied respectively. Meanwhile, method of appropriate risk allocation in D.B.B construction contracts from perspective of claim management has been compared with method of risk allocation in terms of general provisions of ordinary contracts and its new draft which is under review and survey.
