بررسي ارتباط دعاوي در پروژه هاي عمراني با اسناد و شرايط پيمان

چكيده اين پژوهش به « بررسي ارتباط دعاوي در پروژه هاي عمراني با اسناد و شرايط پيمان» مي پردازد. شناسايي تغييرات زماني پروژه و فعاليتها، تغيير در دستور كار و شناسايي عوامل ايجاد تغييرات، فعاليت هاي حذف و يا اضافه شده به پروژه در طول كار و وجود ابهامات و نواقص در اسناد و شرايط پيمان، مبناي تدوين دو فرضيه بوده است. تحقيق حاضر به لحاظ دسته بندي بر مبناي هدف، تحقيقي كاربردي است كه سعي دارد تا به بررسي ميزان ارتباط دعاوي در پروژه هاي عمراني با اسناد و شرايط پيمان و ارائه راهكار جهت مديريت آنها بپردازد. روش تحقيق استفاده از مطالعه موردي است كه يكي از انواع روشهاي تحقيق علمي با رويكرد اكتشافي مي باشد. ابزار گردآوري اطلاعات دراين پژوهش، پرسشنامه محقق ساخته مي باشد. جامعه آماري اين پژوهش براساس آمار سال جاري، تمامي شركت هاي عمراني فعال استان آذربايجان شرقي (رتبه 4 به بالا) بوده و حداقل سه پروژه مهم دولتي و عمراني را كار كرده اند: (180= N). نمونه آماري اين پژوهش 118 نفراز مديران اين شركت ها (مدير عامل يا عضو هيات مديره) هستند: (118= S). درانتخاب حجم نمونه از جدول كرجسي و مورگان استفاده شده است . شيوه نمونه گيري تصادفي ساده (SRS) است. در بخش تحليل هاي استنباطي به منظور بررسي فرضيه هاي پژوهش از آزمون هاي پارامتريك (t تك نمونه اي ) استفاده كرده ايم. در كليه محاسبات آماري از نرم افزار SPSS استفاده شده است. پس از بررسي هاي بعمل آمده، مشخص گرديد كه عوامل متعددي مرتبط با اسناد و شرايط پيمان در بروز دعاوي تاثير بسزايي دارند. كنترل و برنامه ريزي ضعيف پروژه، تغيير مقادير كار و حجم بالاي دستورات تغيير، سو بهره برداري پيمانكاران از ابهامات شرايط پيمان و اسناد مناقصه، عدم تنظيم شفاف مراحل اجراي پروژه، نقض قرارداد، عدم دقت در برآورد هزينه و زمان اتمام پروژه، سهيم نبودن برنامه ريزان و طراحان در فرآيندهاي اجرايي، مداخله كارفرما و مهندس مشاور در مستندات قرارداد و كامل نبودن طراحي و مشخصات كار تا پيش از مناقصه به ترتيب بيشترين تاثير را در بروز دعاوي داشته اند. واژه‌هاي كليدي: ادعا، اسناد و شرايط پيمان، تغيير دستور كار

Investigation of the relationship of claims in civil projects with contract’s documents and terms

Abstract: This research seeks to "investigate the relationship of claims in construction projects with contract’s documents and contract terms". Identifying the project’s time and activity changes, work change orders and identifying the factors that make changes, removed or added activities to the project during the work and the existence of ambiguities and deficiencies in contract’s documents and terms has been the basis for codification of two hypotheses. The present research is a practical research that aims to investigate the relationship of claims in construction projects with contract’s document and contract terms. The research method is using a case study which is one of the varieties of scientific research methods with exploratory approach. The data gathering tool in this research is a researcher-made questionnaire. The statistical population of this research is based on the statistics of this year, are all active civil engineering companies of East Azarbaijan province (rank 4 and up) and have worked at least on three important and governmental civil projects: (N = 180). The statistical sample of this research is 118 managers of these companies (CEO or board member): (118 = S). The sample size is extracted from the Krejcy and Morgan table. The sampling method is simple random. In the inferential analysis, we used parametric tests (one-sample t) to study the research hypotheses. All statistical calculations were performed using SPSS software. After the investigation, it was revealed that several factors related to the documents and conditions of the contrac have significant impact on the claims. Poor project control and planning, changes in work order and large amount of change orders, contractors' exploitation of ambiguities, contract terms and bidding documents, lack of clear regulation of project implementation, contract breach, inaccuracies in cost estimation and completion time of the project, non-participation of Planners and designers in executive processes, employer and consultant engineers' interference in contract documentation, and the lack of design accuracy and specifications of work prior to the bidding have had the most impact on the claims.
