صنعت ساختمان همواره با مشكلاتي مواجه است كه باعث افزايش زمان و هزينه پروژه مي شود و همين امر باعث مي شود پروژه با كيفيت مطلوب به پايان نرسد. با استفاده از مدل سازي اطلاعات ساختمان (BIM) اين مشكل تا حد زيادي حل شده است. بر اين اساس هدف پژوهش حاضر بررسي ادعاها با توجه به اهميت مدل‌سازي ‌اطلاعات‌ساختمان در كاهش دعاوي قابل بحث ساخت‌و‌ساز مي¬باشد. اين پژوهش ازنمونه پژوهش-هاي كاربردي است. جامعه آماري شامل خبرگان حوزه ساخت‌و‌ساز است. روش نمونه‌گيري تركيبي از دو روش نمونه‌گيري غيراحتمالي هدفمند (قضاوتي) و نمونه‌گيري گلوله برفي مي¬باشد. ابزار گردآوري¬داده¬ها شامل پرسشنامه¬ است و شامل دو دسته پرسشنامه¬ي مرحله¬ي دلفي مي¬باشد و پرسشنامه¬ي ابزار مقايسات زوجي مي¬باشد. در اين پژوهش جهت تجزيه و تحليل داده‌ها، از دو روش دلفي و فرآيند تحليل شبكه در دو نرم‌افزار Excel و SuperDecision استفاده شده است. نتايج نشان داد كه BIM مي¬تواند از طريق حوزه¬هاي جنبه‌هاي حقوقي بالقوه/مفاد قرارداد براي ساختار و خط مشي قرارداد (A) و جنبه‌هاي حقوقي بالقوه / مقررات قرارداد براي قواعد رويه‌اي هيئت اختلاف (B) و جنبه‌هاي حقوقي بالقوه / مقررات قرارداد براي نقش¬ها و تعهدات (C)، كمك شاياني به حوزه¬ي ساخت و ساز كند. با توجه به تحليل نهايي و تعيين اولويت معيارهاي موثر بر پژوهش براساس ANP، قابل مشاهده است معيار "جنبه‌هاي حقوقي بالقوه/مفاد قرارداد براي ساختار و خط مشي قرارداد (A)" با وزن "53961/0" به عنوان مهمترين معيار مدل يكپارچه ANP، براي رتبه‌بندي معيارهاي مؤثر با استفاده از روش ANP، تعيين شد و معيار " جنبه‌هاي حقوقي بالقوه / مقررات قرارداد براي قواعد رويه‌اي هيئت اختلاف (B) " با وزن0.29696، داراي رتبه دوم است و معيار " جنبه‌هاي حقوقي بالقوه / مقررات قرارداد براي نقشها و تعهدات (C) " با وزن نهايي0.16342 داراي كمترين رتبه تعيين شده از عوامل مربوط به معيارهاي مؤثر بر منبع ادعاها با اهميت مدلسازي ‌اطلاعات‌ساختمان در كاهش دعاوي قابل بحث ساخت و ساز است.

Examining claims considering the importance of building information modeling in reducing debatable construction claims

The construction industry is always faced with problems that increase the time and cost of the project, and this causes the project to not be finished with the desired quality. Using Building Information Modeling (BIM) this problem has been largely solved. Based on this, the aim of the current research is to investigate the source of claims with the importance of building information modeling in reducing debatable construction claims. This research is an example of applied research. The statistical population includes experts in the field of construction. The sampling method is a combination of two non-probability targeted (judgmental) sampling and snowball sampling. The data collection tool includes a questionnaire, and it includes two types of questionnaires, the Delphi stage and the pairwise comparison tool questionnaire. In this research, two Delphi methods and the network analysis process were used in Excel and SuperDecision software to analyze the data. The results showed that to answer the main question, it can be stated that BIM can be used through the areas of potential legal aspects/contract provisions for contract structure and policy (A) and potential legal aspects/contract provisions for rules. Dispute Board Procedures (B) and Potential Legal Aspects/Contract Provisions for Roles and Obligations (C) provide valuable assistance to the construction industry. According to the final analysis and prioritization of criteria affecting the research based on ANP, it can be seen "Potential legal aspects/contract provisions for the structure and policy of the contract (A)" with a weight of 0.53961 as the most important criterion of the ANP integrated model. To rank the effective components using the ANP method, it was determined and "potential legal aspects / contract provisions for the procedural rules of the dispute panel (B)" with a weight of 0.0.29696, has the second rank And "Potential legal aspects / contract provisions for roles and obligations (C)" with a final weight of 0.16342 has the lowest rank of the factors related to the components affecting the source of claims with the importance of building information modeling in reducing construction debatable claims.
